A ju\u00edza do Trabalho Audrey Choucair Vaz, em exerc\u00edcio na\u00a016\u00aa Vara do Trabalho de Bras\u00edlia<\/a>, deferiu indeniza\u00e7\u00e3o por danos morais \u2013 fixada em R$ 5 mil \u2013 a uma t\u00e9cnica de enfermagem que trabalhava no centro cir\u00fargico de um hospital do Distrito Federal e contraiu\u00a0Covid-19<\/a>.<\/h5>\n
De acordo com a magistrada, nos casos de Covid como doen\u00e7a ocupacional, \u00e9 poss\u00edvel autorizar indeniza\u00e7\u00e3o \u00e0 v\u00edtima quando o trabalho desempenhado for considerado atividade de risco elevado para contrair o novo coronav\u00edrus.<\/h5>\n

Na a\u00e7\u00e3o, a profissional conta que trabalhou no hospital de junho de 2017 a outubro de 2020, tendo sido acometida pela doen\u00e7a em junho de 2020. Contudo, ela afirmou que o hospital a despediu, e, diante disso, pediu o pagamento de indeniza\u00e7\u00e3o por danos morais no valor de R$ 10 mil.<\/h5>\n
Em defesa, o hospital alegou que a autora utilizava os adequados equipamentos de prote\u00e7\u00e3o, n\u00e3o sendo poss\u00edvel afirmar que a Covid-19 foi contra\u00edda no ambiente de trabalho.<\/h5>\n
Na senten\u00e7a, a magistrada salientou que, como a autora trabalhava no centro cir\u00fargico do hospital, onde tamb\u00e9m eram realizadas cirurgias e procedimentos em pacientes infectados com Covid-19, e n\u00e3o tendo ocorrido adoecimento em sua resid\u00eancia ou fam\u00edlia antes do adoecimento da trabalhadora, e, ainda, considerando o elevado n\u00famero de profissionais do centro cir\u00fargico que foram acometidos pela Covid-19, h\u00e1 evid\u00eancias suficientes para acreditar que a doen\u00e7a foi contra\u00edda durante a realiza\u00e7\u00e3o das atividades laborais.<\/h5>\n
Ainda de acordo com a ju\u00edza, a a\u00e7\u00e3o aponta que o hospital n\u00e3o teve culpa, uma vez que observou os cuidados necess\u00e1rios, incluindo todos os equipamentos de prote\u00e7\u00e3o individual adequados.<\/h5>\n
Assim, salientando que a trabalhadora n\u00e3o ficou com sequela da doen\u00e7a, a magistrada estipulou o valor da indeniza\u00e7\u00e3o por danos morais em R$ 5 mil.<\/h5>\n
