O Tribunal de Justi\u00e7a do Distrito Federal e dos Territ\u00f3rios (TJDFT<\/a>) condenou a\u00a0companhia a\u00e9rea Tap Air Portugal<\/a> a indenizar dois passageiros por danos morais e materiais. A empresa exigiu um teste de diagn\u00f3stico de Covid-19 sem necessidade.<\/p>\n

Os clientes entraram com a\u00e7\u00e3o judicial. Eles contam no processo que um atendente da TAP lhes informou que o teste n\u00e3o seria necess\u00e1rio porque os passageiros t\u00eam certificado de vacina\u00e7\u00e3o emitido na Su\u00ed\u00e7a.<\/p>\n

Na hora do check-in, no aeroporto de Guarulhos, a empresa pediu que os dois pagassem R$ 560 para ter os testes. Um exame negativo de Covid-19 \u00e9 requisito obrigat\u00f3rio para entrar em Portugal, o destino dos autores da a\u00e7\u00e3o. Depois do transtorno, os testes n\u00e3o foram requisitados em Portugal, bastou o cart\u00e3o de vacina\u00e7\u00e3o su\u00ed\u00e7o.<\/p>\n

A empresa afirmou na defesa que agiu de boa-f\u00e9 e prestou as informa\u00e7\u00f5es necess\u00e1rias. Disse ainda que n\u00e3o h\u00e1 comprova\u00e7\u00e3o da vers\u00e3o dos clientes.<\/p>\n

A julgadora do caso, a magistrada Oriana Piske, entendeu ser abusiva a exig\u00eancia de realiza\u00e7\u00e3o do teste PCR para embarque dos clientes depois de ter informado que n\u00e3o seria preciso. A ju\u00edza caracterizou como \u201ccrassa falha de servi\u00e7o\u201d da empresa o impedimento injustificado do embarque.<\/p>\n

Assim, a TAP Air Portugal foi condenada a ressarcir aos autores a quantia de R$ 560,00, a t\u00edtulo de dano material, e a pagar aos requerentes o valor de R$ 6 mil, sendo metade para cada autor, por danos morais. Cabe recurso da senten\u00e7a.<\/p>\n
